Terms of Service
These Terms of Service ("Terms") govern access to and use of Freely (the "Service"), a survey and campaign platform for businesses, provided by [Legal Entity Name — TBD] ("Freely," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms.
1. Who this is for
Freely is a business tool. Creating an account automatically creates a workspace under your account, and the Service is built around workspaces (with owner, manager, member, and billing roles) creating and distributing surveys and analyzing responses — not around individual consumer use. You must be able to form a binding contract to create an account, and the account holder is responsible for their workspace's use of the Service, including the actions of everyone they invite to their workspace.
2. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access. You're responsible for the accuracy of information you provide (email, display name, workspace name, logo) and for managing who you invite to your workspace and what role you give them — roles control real permissions, including billing and the ability to remove other members.
3. Survey content and respondent data — your responsibility
You control what your surveys ask. The Service lets you build questions that collect whatever information you choose from respondents, including free-text answers that could include names, emails, phone numbers, or other personal information. You're solely responsible for:
- having a lawful basis to collect whatever data your surveys ask for, and for your own privacy notice to respondents where one is legally required;
- not using the Service to collect data unlawfully, or in a way that violates a respondent's rights or applicable law (e.g. health, financial, or other regulated data you're not permitted to collect this way);
- any destination you configure for your data — for example, if you set up a webhook, every completed response (including respondents' free-text answers) is sent by us to the URL you provide. That's a data flow you control, to a destination you chose; we're the conduit, not the recipient, and we aren't responsible for what you or your configured destination do with it afterward;
- any API key you generate for the embed SDK — keys are shown once and should be treated as credentials; you're responsible for revoking a key if it's exposed.
4. Acceptable use
You agree not to:
- use the Service to collect sensitive personal data in violation of applicable law, or to harass, defraud, discriminate against, or deceive respondents;
- attempt to bypass survey access controls (PIN protection, email verification, single-use links) other than your own;
- probe, scan, or attempt to defeat rate limits or abuse protections on the Service, or otherwise interfere with its normal operation;
- use the Service to send unsolicited bulk communications;
- reverse-engineer, resell, or white-label the Service without our written permission.
5. Plans and billing
Some features require a paid plan. Paid plans are billed through Stripe on a recurring basis (monthly or annual, as selected); we never see or store your card details — Stripe's hosted checkout handles payment directly. Upgrading, downgrading, and cancellation are available from your billing settings and take effect per the terms shown at checkout. Freely's paid plans are currently in test/staging billing mode and no real charges are processed yet — this section will be finalized before live billing is enabled.
6. Your data, our access
You own the survey and response data your workspace collects through the Service. We access it only as needed to operate, secure, and support the Service (see our Privacy Policy for how we handle it), or as required by law. Deleting your workspace through account settings deletes your surveys, responses, and related data along with it — this can't be undone.
7. Service availability
The Service is provided "as is" during this pre-launch/beta period. We don't currently guarantee any specific uptime or service-level commitment, and features may change as the product develops. We'll aim to give notice of significant changes that affect your data or billing.
8. Termination
You may stop using the Service and delete your workspace at any time from account settings. We may suspend or terminate access for violating these Terms, for suspected abuse, or for nonpayment of a paid plan, with notice where reasonably possible.
9. Limitation of liability
To the extent permitted by law, Freely isn't liable for indirect, incidental, or consequential damages arising from use of the Service, including for data you or your respondents submit, or for third-party destinations you configure (webhooks, embed sites). [Full liability/indemnification language — TBD, pending legal review.]
10. Governing law
[Governing law and jurisdiction — TBD, depends on the entity registering Freely; see internal roadmap notes.]
11. Changes to these Terms
We may update these Terms as the Service evolves. We'll update the "Last updated" date above; material changes will be communicated to account holders.
